REC Terms of Use

Version 2.1 — in force since 9 September 2026

These Terms of Use (the “Terms”) form a contract between you and the publisher of the REC application. They describe what the service allows you to do, what you undertake not to do, and the rights available to you. We encourage you to read them: they are written to be understood.

Article 1 — Purpose, acceptance and contractual documents

1.1. These Terms define the conditions under which the Publisher makes the REC mobile application (the “Application”) and its related services (together, the “Service”) available, and the conditions under which the Service is used by any person accessing it (the “User”).

1.2. Acceptance of the Terms is full, entire and indivisible. It is obtained when the account is created, by means of a separate tick box, and cannot be partial. If you do not accept these Terms, you must not use the Service.

1.3. The contractual documents are, in decreasing order of precedence: these Terms, the Content Charter set out in Schedule 1, and the Privacy Policy. In the event of a conflict, the higher-ranking document prevails.

1.4. For each account, the Publisher records the version number of the Terms accepted and the date of that acceptance.

Article 2 — Identification of the Publisher, the hosting provider and the point of contact

2.1. Publisher of the Service

2.2. Hosting

The Service is hosted by OVH SAS, a simplified joint-stock company with share capital of €10,174,560, registered with the Lille Métropole Trade and Companies Register under number 424 761 419, whose registered office is at 2 rue Kellermann, 59100 Roubaix, France. Data is hosted within the European Union.

2.3. Single point of contact

In accordance with articles 11 and 12 of Regulation (EU) 2022/2065 on digital services (the “DSA”), the Publisher designates the following single point of contact, for authorities and users alike: hello@rectheapp.com. The accepted languages of communication are French and English.

Article 3 — Definitions

Article 4 — Conditions of access to the Service

4.1. Minimum age. The Service is reserved for persons aged at least fifteen (15), the threshold applied in France for a minor’s consent to the processing of their data in the context of an information society service (article 7-1 of French Act No. 78-17 of 6 January 1978). A User aged between fifteen and eighteen declares that they have the authorisation of the holder or holders of parental authority.

4.2. Capacity. The User declares that they have the legal capacity to enter into a contract. A User acting on behalf of a legal entity declares that they have the power to bind it.

4.3. One account per person. Save with the Publisher’s written authorisation, a User may hold only one Account. Creating a new account is prohibited for any person whose account has been terminated for breach.

4.4. Technical means. Access to the Service requires a compatible device and an Internet connection, the cost and proper functioning of which remain the User’s sole responsibility.

Article 5 — User account

5.1. Creation. Creating an Account requires a valid email address, a unique username, a display name and a password. The email address is verified by sending a single-use confirmation link.

5.2. Accuracy. The User undertakes to provide accurate information and to keep it up to date. The password is stored as a cryptographic hash and is never accessible to the Publisher in clear text.

5.3. Security. The User is responsible for keeping their credentials confidential and for acts carried out from their Account. They undertake to inform the Publisher without delay, at hello@rectheapp.com, of any unauthorised use or any suspicion of compromise.

5.4. Personal nature. The Account is personal. It may not be assigned, lent, shared or sold.

Article 6 — Description of the Service

6.1. The Service allows the User in particular to record and publish voice Notes together with a title and sound effects, to set their Account as public or private, to follow other Users, to listen, like, comment and mention, to exchange Private Messages in one-to-one or group conversations, to share a Note within a conversation, and to receive notifications.

6.2. The Service automatically applies to each Note a text transcript and thematic keywords, under the conditions of article 9.

6.3. The Service is provided free of charge. The Publisher reserves the right to introduce paid features; those features will then be subject to separate terms accepted separately, and features already used free of charge will not become chargeable without the User’s express agreement.

6.4. The Service is provided in the state of its features on the day it is used. The Publisher may develop it, and may modify or remove features. Any removal of a substantial feature is notified under the conditions of article 21.

Article 7 — Content published by the User

7.1. Ownership of rights

The User remains the owner of all intellectual property rights they hold in their User Content. These Terms do not transfer any of those rights.

7.2. Licence granted to the Publisher

So that the Publisher can provide the Service, the User grants it, over their User Content, a non-exclusive, royalty-free, worldwide licence, sub-licensable only to the technical providers listed in article 14, comprising the rights to reproduce, store, transcode, segment, technically adapt, transcribe, index, generate a graphical representation of the sound signal, and communicate the Content to the audience the User has themselves chosen through their settings.

This licence is granted solely for the purposes of operating and promoting the Service. It authorises neither the commercial exploitation of the Content outside the Service, nor its assignment, nor its advertising use outside the Service, nor its use for training artificial intelligence models.

7.2 bis. Sharing a voice Note outside the Service

The Service allows the User to share a voice Note by means of a link accessible without an account. Activation of that feature by the User, for a given Note, extends the licence defined in article 7.2 to the communication of that Note on a public web page of the Publisher, including its reproduction in the form of an automatically generated preview image (title, username, graphical representation of the sound signal, duration), intended for the display of the link on the third-party services where the User distributes it.

This extension is limited to Notes published from a public Account. It applies neither to private Accounts, nor to Private Messages, nor to Notes that have been removed or are under review.

The pages so created carry a no-indexing instruction addressed to search engines. The Publisher does not guarantee that the third-party services to which the User sends the link will comply with it, nor that they will not retain a copy of the preview.

Deleting the Note, switching the Account to private mode or deleting the Account renders the link inoperative. The Publisher cannot, however, recall copies already made by third parties before that removal, of which the User is informed before any sharing.

The licence is granted for the period during which the Content is online and ends when it is deleted, subject to the following reservations, inherent in the operation of an online service: the technical time needed to purge backups; Content that another User has legitimately received in a private conversation; and Content whose retention is required by law or necessary for the establishment, exercise or defence of legal claims.

7.3. User warranties

The User warrants that they hold all rights and authorisations necessary to publish their Content. In particular, they warrant:

7.4. Indemnity

The User shall indemnify the Publisher against any claim, action or award arising out of Content they have published, up to the amount of the loss actually suffered, provided that the Publisher informed them of the claim within a reasonable time and enabled them to take part in its defence.

Article 8 — Prohibited conduct

Irrespective of the content covered by Schedule 1, the User is prohibited from:

Article 9 — Automated processing and use of artificial intelligence

9.1. Each published Note is subject to automated processing intended to produce a text transcript, extract thematic keywords and characterise its general tone. That processing involves transmitting the sound content and the title to third-party technical providers, listed in article 14.

9.2. That processing is automatic and fallible. The Publisher does not guarantee the accuracy, completeness or relevance of the transcripts and keywords produced. The User may correct the keywords associated with their own Notes from the editing screen.

9.3. No decision to remove content, to suspend or to terminate is based solely on automated processing producing legal effects or significantly affecting the User without the possibility of human intervention. Any such decision may be re-examined by a natural person under the conditions of article 11.

Article 10 — Notice and action on content

10.1. Status of the Publisher. The Publisher acts as a hosting service provider within the meaning of article 6-I-2 of French Act No. 2004-575 of 21 June 2004 and article 6 of the DSA. It is not subject to any general obligation to monitor the content it stores (article 8 of the DSA). Its liability is engaged only if it fails to act expeditiously to remove Illegal Content once it becomes aware of it.

10.2. Notice mechanism. Any User may report a Note, a comment or a profile from within the Application, or write to hello@rectheapp.com. In accordance with article 16 of the DSA, a notice should include: a sufficiently substantiated explanation of the reasons why the content is considered illegal, the exact location of the content, the name and email address of the person submitting the notice — except where it concerns an offence relating to child sexual abuse — and a statement of good faith.

10.3. Handling. The Publisher acknowledges receipt of notices submitted electronically and handles them diligently, in a non-arbitrary and objective manner. Notices concerning manifestly illegal or manifestly abusive content are examined as soon as possible and, in any event, within twenty-four (24) hours of receipt.

10.4. Measures. Depending on the seriousness of the breach, the Publisher may: remove the content or restrict its visibility, limit certain Account features, suspend the Account, or terminate it. The measure taken is proportionate to the seriousness, the repeated nature and the type of breach.

10.5. Misuse. In accordance with article 23 of the DSA, the Publisher may suspend, after prior warning, the Account of a User who frequently publishes manifestly illegal content, as well as the processing of notices from a person who frequently submits manifestly unfounded ones.

10.6. Orders. The Publisher acts upon orders to act against Illegal Content and requests for information from the competent authorities, under the conditions of articles 9 and 10 of the DSA, and informs the User concerned where the applicable law allows it.

Article 11 — Statement of reasons and redress

11.1. Statement of reasons. Any decision to remove content, restrict visibility, suspend or terminate is accompanied, for the benefit of the User concerned, by a clear and specific statement of reasons complying with article 17 of the DSA. That statement specifies the measure taken and its territorial and temporal scope, the facts on which it is based, where applicable the use of automated means of detection, the contractual clause or legal provision relied on, and the redress available.

11.2. Internal complaint. The User to whom such a decision is addressed, as well as the person who submitted a notice, have six (6) months from notification to challenge it free of charge at hello@rectheapp.com. The complaint is examined by a natural person with the necessary competence, and is answered with reasons. The decision is reversed if it proves unfounded.

11.3. Other redress. Exercising this internal redress deprives the User neither of the right to use an out-of-court dispute settlement body certified under article 21 of the DSA, nor of their right to bring legal proceedings.

11.4. The Publisher falls within the category of micro and small enterprises within the meaning of article 19 of the DSA, to which some of these obligations do not apply; it submits to them voluntarily and undertakes contractually to comply with them.

Article 12 — Recommender system

12.1. In accordance with article 27 of the DSA, the Publisher informs Users of the main parameters of the “For you” feed: the interests declared by the User, the thematic keywords associated with Notes, the User’s explicit interactions — likes, comments and follows — and how recent the Notes are.

12.2. Plays are deliberately excluded from the affinity calculation: scrolling through a feed does not express interest in each of the Notes it contains.

12.3. The User may at any time use the “Following” feed, which presents, without algorithmic personalisation, only the Notes of the Users they follow, and may change their interests from their Account.

Article 13 — Private messaging

13.1. Private Messages are not accessible to the public. They are not, however, end-to-end encrypted: the Publisher has the technical ability to access them. It does so only in the event of a notice, in order to comply with an order from a competent authority, or to ensure the security of the Service.

13.2. Schedule 1 applies to Private Messages. The private nature of an exchange does not exclude the criminal liability of its author.

13.3. Deleting an Account does not delete messages already received by their recipients.

Article 14 — Personal data

14.1. The processing of personal data is described in the Privacy Policy, which sets out the purposes pursued, the legal bases, the retention periods and how to exercise the rights granted by Regulation (EU) 2016/679 (the “GDPR”): access, rectification, erasure, restriction, objection and portability.

14.2. To provide the Service, the Publisher uses the following providers, acting as processors: OVH SAS (hosting, European Union); Mailjet SAS (sending emails, European Union); ElevenLabs (automatic transcription); OpenAI (thematic classification and tone analysis); Expo (delivery of notifications). Transfers outside the European Union are governed by the appropriate safeguards provided for in Chapter V of the GDPR.

14.3. The User may send any request relating to their data to hello@rectheapp.com. They have the right to lodge a complaint with the French Data Protection Authority (Commission nationale de l’informatique et des libertés, CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France.

Article 15 — The Publisher’s intellectual property

15.1. The Application, its code, its interface, its graphic and sound elements, its name, its logo and its databases are protected by intellectual property law and remain the exclusive property of the Publisher or its licensors. The Publisher claims database producer protection under article L. 341-1 of the French Intellectual Property Code.

15.2. The User is granted a personal, non-exclusive, non-transferable and revocable right to use the Application, for the duration of their registration and solely for the purpose of using the Service in accordance with its intended use.

Article 16 — Availability and development of the Service

16.1. As regards the availability of the Service, the Publisher is bound by an obligation of best efforts. It takes reasonable care to ensure its accessibility and security.

16.2. The Service may be interrupted for maintenance, updates or security reasons. The Publisher endeavours to announce scheduled interruptions likely to significantly affect use in advance.

16.3. The User is advised to keep their own copies of recordings that matter to them. The ability to export their data is available to them under the right to portability.

Article 17 — Legal guarantee of conformity

The Service is a digital service supplied without payment of a price but in exchange for the provision of personal data. On that basis, a User who is a consumer benefits from the legal guarantee of conformity provided for in articles L. 224-25-1 et seq. of the French Consumer Code. No provision of these Terms may be construed as an obstacle to it.

Article 18 — Liability

18.1. The User is solely responsible for their Content, for the use they make of the Service and for the consequences of that use.

18.2. The Publisher exercises no prior control over User Content and is not liable for it, within the limits of the liability regime applicable to hosting service providers. Nor is it liable for relationships formed between Users, or for failures of communication networks or devices.

18.3. No provision of these Terms has the object or effect of excluding or limiting the Publisher’s liability in the event of wilful misconduct, gross negligence, personal injury, breach of an essential obligation of the contract, or in any other case where the law prohibits it.

18.4. The Service may link to third-party content or services, over which the Publisher exercises no control and for which it is not liable.

Article 19 — Term, suspension and termination

19.1. The contract is entered into for an indefinite term from the acceptance of these Terms.

19.2. The User may terminate at any time, without reason, without notice and free of charge, by deleting their Account from the Application.

19.3. The Publisher may suspend or terminate an Account in the event of a breach of these Terms. Save in the event of a serious breach, manifest illegality, harm to the security of the Service or a legal obligation, the measure is preceded by a warning and a reasonable period in which to remedy it. Every measure is reasoned and open to the redress provided for in article 11.

19.4. Termination does not affect accrued rights or the provisions intended to survive the contract, in particular articles 7.4, 15, 18 and 23.

Article 20 — Account deletion and what happens to the data

20.1. Deleting the Account entails the deletion of published Notes, messages sent, notifications and personalisation data. The Account’s identifying data is irreversibly anonymised in order to preserve the coherence of exchanges already received by third parties.

20.2. A Note deleted individually is placed in a bin and remains restorable by its author for thirty (30) days, after which its deletion becomes permanent.

20.3. Certain data is retained beyond that period where the law requires it or where its retention is necessary for the establishment, exercise or defence of legal claims, in particular connection data under the conditions of article L. 34-1 of the French Postal and Electronic Communications Code.

Article 21 — Changes to the Terms

21.1. The Publisher may amend these Terms, in particular to take account of a change in the Service, in regulations or in case law.

21.2. Any substantial change is brought to Users’ attention by email or by a notice in the Application, at least thirty (30) days before it takes effect.

21.3. A User who refuses the new version may terminate free of charge before its effective date. Continuing to use the Service beyond that date constitutes acceptance.

21.4. Changes required by an immediately applicable legal or regulatory provision take effect without delay.

Article 22 — Force majeure

Neither party may be held liable for a failure to perform its obligations resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code.

Article 23 — Miscellaneous

23.1. Assignment. The Publisher may assign this contract in the context of a merger, contribution or transfer of business, subject to informing Users in advance, who may then terminate free of charge.

23.2. Partial invalidity. If a provision of these Terms were declared void or deemed unwritten, the remaining provisions would retain full effect.

23.3. No waiver. The fact that the Publisher does not rely on a breach does not constitute a waiver of the right to rely on it later.

23.4. Evidence. The Publisher’s computerised records, kept under reasonable security conditions, are admitted as evidence of connections, acceptances and operations carried out.

23.5. Language. These Terms are drawn up in French. This English text is a translation provided for information only; in the event of any discrepancy, the French version prevails.

Article 24 — Governing law and dispute resolution

24.1. These Terms are governed by French law, without prejudice to the more protective mandatory provisions of the country in which a consumer User habitually resides.

24.2. Prior complaint. The User is invited to send any complaint to hello@rectheapp.com, and the Publisher undertakes to answer it within a reasonable time.

24.3. Consumer mediation. The Service is published on a non-professional basis and without financial consideration. The Publisher therefore does not fall within the scope of article L. 612-1 of the French Consumer Code and is not covered by any consumer mediator. Should that situation change, these Terms would be updated and the User informed under the conditions of article 21.

24.4. Jurisdiction. Failing an amicable settlement, the dispute is brought before the courts having jurisdiction under the ordinary rules of law. A consumer User may bring proceedings, at their choice, before the court of the place where they were residing when the contract was concluded or when the harmful event occurred, in accordance with article R. 631-3 of the French Consumer Code.

Article 25 — Provisions specific to app stores

25.1. These Terms are entered into between the User and the Publisher, to the exclusion of Apple Inc. and Google LLC, which are not parties to them. The Publisher is solely responsible for the Application, its content and its support.

25.2. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against the User. Apple has no maintenance or support obligation, and gives no warranty in respect of the Application.

25.3. The User declares that they are not located in a country subject to a United States embargo and are not listed on any United States government list of prohibited parties.

Schedule 1 — Content Charter

The following are prohibited, in the public areas of the Service as well as in Private Messages:

This list is not exhaustive. Any content contrary to the laws and regulations in force is prohibited, even if it does not appear expressly above.
